Rule proposal 36: No judgement calls

Post  HPew on Sun Nov 16, 2008 2:40 pm

All past, present, and future rules which include the creation of a role, for person or persons, to decide whether another's action is in accord or infringing a rule and reward or penalize accordingly are forbidden.

This is spun off from my concern over "copyright". I want to prevent the creation of committees who can make decisions which penalize individuals without the individual having any obvious recourse if they feel the judgement is unfair.

I am not opposed to rules which reward or penalise, but I want all rules to be sufficiently unambiguous that there is no need for any 'rule judging' bodies to exist.

Rules which forbid the creation of other rules are frowned upon, as it's assumed we can make up our own minds when a controversial one comes up.

Vote: No

This may be a slightly idealistic view. At some point, there will be judgment calls.

Rules which try and stop a bad thing are good. And I'm not forbidding the creation of any rule, I'm trying to prevent the start of what will become a cronyistic bureaucracy.

I'm not anti-judgement, I'm anti giving control of this judgement to a subset of people who can use the rules for their particular benefit.

Well... as of now, I agree with Mokina's first point. I'll vote NAY, tentatively.

Vote no

Ever step outside?

Read a book?

See a movie or T.V show?

Judges are practically essential to keep society and law enforcement in check.

To be fair, HPew has a point about corruption. We're going to have to be a vigilant community if a judicial system is implemented, but with the proper impeachment clauses, the benefits will far outweigh the costs.

An internal moral code keeps society in check. Being kept from anti-social behaviour only by the threat of judges and law enforcement is - in absolute fact - sociopathic.

Some will choose to take advantage of other people, given the opportunity, as the benefits involved outweigh any ethical concern. Fear of punishment is a crude tool, but it tends to tip the balance.
